The Commission has significantly revised its approach with regard to the existence of State aid in projects where infrastructure is financed or co-financed by the State or through State resources (including EU funds). As a consequence of the judgment of the General Court of 24 March 2011 in joined cases T-443/08 and T-455/08 Leipzig-Halle (confirmed on 19 December 2012 by the Court of Justice in judgement in case C-288/11 P), State aid may be present in projects concerning financing of the infrastructure, regardless of character of entity responsible for its realization, as long as the infrastructure can be economically exploited
